TERMS AND CONDITIONS

1. About these terms and conditions

   1. This Website and Reserve and Collect are provided by Dufry d.o.o. Belgrade (“we/us/our”). We are a company registered in the Republic of Serbia and our registered office is at Aerodrom "Nikola Tesla", 11180 Belgrade 59, Serbia. When we refer to “you” and “your” we mean the user of our Website and/or Reserve and Collect.

   2. These are the Terms which apply to your use of our Website and your use of Reserve and Collect and by using our Website and/or Reserve and Collect you agree to be bound by these Terms. If you do not agree to these Terms you must not use our Website or Reserve and Collect. Please read these Terms carefully and make sure that you understand them before using the Website or Reserve and Collect.

   3. These Terms will apply to any contract between us which may be formed under the terms and conditions agreed by us when you access our Website and/or when you use Reserve and Collect.

   4. These Terms only apply to your viewing and use of this Website and Reserve and Collect. If you use one of the links on this Website to visit one of our partner websites, then please note that when you’re viewing these websites, any purchases made through them will be subject to separate terms and conditions.

   5. When the following words with capital letters are used in these Terms, this is what they mean:

      “Privacy Policy” our privacy policy, a copy of which is available at this link

      “Products” any of the products featured on our Website or included in a reservation;

      “Reserve and Collect” the reservation service (offered by us via our Website and as advertised in our store or on any of our websites as ‘Reserve and Collect’) which allows you to reserve Products ahead of a flight for collection at our duty free stores in Nikola Tesla International Airport (Belgrade, Serbia) just prior to the flight;

      “Terms” these terms and conditions and/or any updates and/or any amendments thereto and the other documents referred to in it, including our Privacy Policy; and

      “Website” our website at www.shopdutyfree.com

   6. If you have any questions on these Terms, or would like to discuss a reservation made through Reserve and Collect please contact our Customer Support Team using the contact details in Clause 17 below.

   7. When we use the words "writing" or "written" in these Terms, this will include e-mail correspondence unless stated otherwise.

2. Reserve and Collect

   1. Reserve and Collect is available to all passengers who in accordance with local legislation are entitled to purchase goods in duty-free stores. You can find details of our stores and those offering Reserve and Collect on the Website.

   2. Payments for Products reserved via Reserve and Collect will be taken when you collect the Products from our store. You do not have to make any payment or provide any payment information through the Website. Please see clause 11 below for further information on payment.

   3. Reservation requests must be made a minimum of 24 hours prior to departure and no more than one month prior to departure. Reservation requests made any sooner or later than this cannot be accepted by us. Note that any products that cannot be reserved due to these timing restrictions can be added to a “Wish List”, which is stored for future viewing by you.

   4. After you make a reservation request via the Reserve and Collect service, you will receive an email (“ReceiptConfirmation Email”) from us acknowledging that we have received your request and we will assign you a reservation request number. This reservation request number must be quoted in all subsequent correspondence with us relating to your request. Please note that the Confirmation Email is Receipt confirmation of your request only, and does not mean it has been accepted. Our acceptance of your request as an actual confirmed reservation will take place as described in clause 2.6.

   5. Within seven (7) days of receiving your Receipt Confirmation Email, you should receive a separate email from us (“Reservation Email”) notifying you whether or not the Products you have requested are available and if they have been reserved for you. The Reservation Email will also include the date on which you can pay for and collect the Products, as well as the location to do so.

   6. When using the Reserve and Collect service, please ensure that the details are complete and accurate before you submit the request. As part of the reservation process, you will also be asked to provide the time, date, departure airport, destination of your flight and an optional flight number. Please take particular care to ensure this information is accurate as we will use it to determine your collection date and time. If, after placing your reservation request and before receiving your Reservation Email, you realise that you have provided us with any incorrect information or you wish to amend your reservation, you can do so via the Website by logging into your account (if a password has been previously set up by you when placing the order). If you realise that you have provided us with any incorrect information or you wish to amend your reservation after you have received your Reservation Email you should cancel your reservation and place a new reservation. Alternatively, please contact our customer support team using the contact details in Clause 17 as soon as possible.

   7. Note that neither the Receipt Confirmation nor the Reservation Emails are a binding offer nor a “promis to sell” agreement. By making a reservation you are only reserving the Products for collection and purchase at the time of departure in compliance with customs requirements, and in store in accordance with these Terms. The completion of the contract between you and us will take place when you pay for and collect the Products in store. Title to any Products you reserve via Reserve and Collect shall pass to you when you collect and pay for the Products in store in accordance with the in store terms of sale.

   8. You can cancel your reservation at any time, including after receiving the Reservation Email. In case you provide us incorrect or incomplete information during the reservation process as required by clause 2.6 of these Terms you will be refused to purchase the Products in store according to your reservation (without respect of the Reservation Email).

   9. We reserve the right to cancel your reservation in whole or in part for any reason at any time. Where we cancel any reservation, we will try to notify you of this prior to your flight time.

3. Products

   1. The images of the Products and any packaging (if applicable) on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products and/or packaging. The Products may vary slightly from those images.

   2. The packaging of the Products may vary from that shown on images on our site.

   3. All Products shown on our site are subject to availability and any duty free restrictions (see Clause 7). At the latest this will be discussed with you at the time of your flight, however, we will try to inform you via the Reservation Email if the Products you have reserved are not available. This earlier email notification just cannot be guaranteed due to timing and administrative limitations.

   4. The range of Products offered on our Website and in our stores (including any of the products that may have been confirmed to you as reserved) is subject to change without prior notice and we reserve the right from time to time, to withdraw or cease to make available any or all of the Products from our Website.

4. Price

   1. We take all reasonable care to ensure that the prices of Products are correct and up to date. However, if we discover an error in the price of the Products you reserved, please see clause 4.2 for what happens in this event. Prices for the Products may change from time to time but any changes will not apply to any reservation which we have confirmed in accordance with clause 2.5.

   2. Our site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have reserved we will try to inform you in writing of this error and we will give you the option of continuing with the reservation of the Products at the correct price or cancelling your reservation, as we will not provide the products to you at the incorrect price. We will not reserve the Products until we have your instructions. If we are unable to contact you using the contact details you provided during the reservation process, we will treat the reservation as cancelled.

   3. We reserve the right to make changes to the prices of the Products from time to time but (except where the changes are due to incorrect pricing) such changes will not apply to any reservations which have been successfully placed, as confirmed by a Reservation Email.

   4. The Reserve and Collect price promise guarantees you the best deal available at the time of the purchase from us. If, when you pay for and collect the Products, they are included in a promotional offer or have been discounted in the store on the date of collection, you will be charged the lower of

      1. The price of the promotional offer or discount; or

      2. The price stated in your Receipt Confirmation Email.

      This only applies to the number of Products that have been reserved and does not apply to products which have been added to the basket within the airport store.

5. Security

   You are solely responsible in all respects for all use of and for protecting the confidentiality of any username, email verification and password that may be given to you or selected by you for use on the Website. You may not share these with or transfer them to any third parties. You must notify us immediately of any unauthorised use of them or any other breach of security regarding the Website that comes to your attention.

6. Changes to these terms and conditions

   1. We reserve the right to amend and/or update these Terms from time to time. Any such changes will take effect immediately when posted on our Website.

   2. Every time you make a reservation with us, the Terms in force at that time will apply to the contract between you and us.

   3. Your continued use of our Website shall signify your acceptance to be bound by the latest Terms.

7. Availability of the Products at time of collection

   1. Your reservation shall automatically be cancelled and the Products returned to the store for general sale if for any reason you do not pay for and collect the Products within 24 hours after your collection date and time stated in your Reservation Email.

   2. To ensure the availability of Products in store which are included in promotional offers, there may be restrictions on the number of certain promotional Products you can reserve. Where any such restriction applies, this will typically be stated on the Website and you will not be able to reserve more than the permitted number of Products.

   3. Availability of Products varies from store to store and details of Products available for reservation (where Reserve and Collect is operating) are shown on the Website.

   4. When you pay for and collect the Products, we reserve the right to limit the number of a particular product we sell to you or to cancel your reservation if the products are not available at the time of collection.

   5. We shall not be liable to you in any way whatsoever where circumstances arise whereby the Products you have reserved are not available or cannot be purchased on the date of your collection.

   6. The Products will be your responsibility once you have collected them and you will own the Products once we have received payment in full.

8. Restrictions

   1. Some of our Products have a minimum age requirement (for example those containing alcohol), and by reserving any of these Products you confirm that you are the required age. We are not allowed by law to supply these restricted products to you if you do not satisfy the age requirements. If you are underage please do not attempt to reserve these Products. You or any person nominated by you may be required to provide proof of your age when you pay for and collect the Products.

   2. All reservations are subject to any applicable customs regulations, quantity or weight restrictions imposed by the airlines and/or duty free regulation. Adherence to any of these regulations and restrictions is your responsibility. If you reserve Products which exceed the allowance under relevant customs regulations, you may be advised (but we have no obligation to advise you) to purchase only the number of Products within the limits set by the applicable customs regulations. We will not be responsible or liable if you purchase more Products than permitted by the applicable regulations.

   3. A valid boarding card must be presented when collecting and paying for the Products, otherwise your reservation will be cancelled and you will be unable to purchase the Products. We reserve the right to deny purchase of the Products which are not available for purchase for the destination stated on the boarding card, but we have no obligation to do so and we will not be responsible or liable if you purchase Products that are not available for the destination stated on your boarding card.

   4. If, for whatever reason, you are unable to pass through airport security into the departure area, we will be unable to fulfil your reservation and your reservation will be cancelled.

   5. Please note that due to customs regulations, we are unable to deliver any uncollected Products to an alternative address outside of the relevant airport departure lounge and the Products can only be collected from the designated collection point at that airport.

9. If the products are faulty

   As a consumer, you have legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local consumer protection authority. Nothing in these Terms will affect these legal rights.

10. Returns

    If you are unhappy with the Products for any reason, you may return them to us in accordance with our sixty (60) day Returns Offer.

11. Payment

    1. You are not obliged to purchase any of the Products you have reserved with us using Reserve and Collect. If you change your mind when you come to pay for and collect the Products you may choose to replace the Products with any other items which are currently available in store. You will pay the price shown in-store for these items. If you no longer wish to purchase the Products, you can cancel your order via the Website prior to your departure date or by informing a member of staff at the store.

    2. We accept payment in store in various currencies. If you wish to pay in a currency other than Serbian dinars (RSD), the conversion rate into the currency you wish to pay in will be determined in accordance with our in-store terms of sale on the actual date of purchase.

12. Limitations on warranties and liability

    1. Subject to clause 12.4, we will use reasonable endeavours to verify the accuracy of any information on the Website but you acknowledge and agree that the Website and the Reserve and Collect service are provided on an “AS IS” and “AS AVAILABLE” basis and we make no representation or warranty of any kind, express or implied, statutory or otherwise regarding the contents or availability of the Website or that it will be timely or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability and of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website and we accept no liability for any kind of loss or damage from action taken in reliance on material or information contained on the Website.

    2. Subject to disclaimers and limitation of warranties stated herein, if we fail to comply with these Terms, we are responsible for any direct and actual loss or damage you suffer that is a foreseeable result of our breach of these Terms. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract between you and us. To the fullest extent permitted by applicable law, we will not be liable to you for any other damages of any kind, including indirect, special, consequential or incidental damages or other damages arising directly or indirectly from your use of (or your inability to use) the Website or of Reserve and Collect.

    3. We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

    4. We do not in any way exclude or limit our liability for:

       1. Death or personal injury caused by our negligence; and

       2. Fraud or fraudulent misrepresentation.

    5. You agree to release, indemnify and hold harmless us, our affiliates, directors, officers, employees, agents and third party licensors, from and against any and all liabilities, losses, damages, claims and expenses, including attorneys’ fees, with respect to (i) your violation of these Terms or our rights or any other person or entity, or any applicable law, (ii) your use or misuse of, or access to the Reserve and Collect service, and/or (iii) any content you make available through the Website. For the avoidance of doubt, this section shall survive the termination of your account on the Website.

13. Use of our website

    1. You are solely responsible for all activity while using our Website and for the security of your computing systems. You assume all liability for losses and damage incurred by us as a result of your activity on our Website, except where such losses are due to a third party who is not known to you who deliberately misuse your log-on details.

    2. We reserve the right to terminate your Website account where you do not comply with these Terms or any applicable laws and regulations relating to the use of our Website. You may amend or cancel your Website account registration at any time via the Website or by contacting our customer support team using the contact details in Clause 17 below.

    3. You must not use the Website for any unlawful or fraudulent purposes. You must not misuse the Website by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. In particular, you must not access without authority, interfere with, damage or disrupt the Website or any part of it; any equipment or network on which the Website is stored; any software used in connection with the provision of the Website; or any equipment, software or website owned or used by a third party. You must not attack the Website via a denial‑of‑service attack.

    4. Without prejudice to our other rights or remedies available under the law, we reserve the right to take legal proceedings against you for reimbursement of all costs or losses (on an indemnity basis) resulting from your breach of clause 13.3, and to disclose such information to law enforcement authorities as we reasonably believe is necessary.

14. Events Outside Our Control

    1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

    2. An Event Outside Our Control means for the purpose of this clause any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, supplier default or delay, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

    3. If an Event Outside Our Control takes place that affects the performance of our obligations under a contract between you and us, we will notify you as soon as reasonably possible.

15. Your restrictions on use of our Website

    Subject to clause 16 below, you may not download, copy, use, make derivative use of or exploit for commercial purposes any proprietary or other information or content on our Website, including, but not limited to, any images, pricing or descriptions of the Products or any brand trademarks, trade names or logos. This includes any copies or derivative created for the benefit of a third party. Use of data mining, robots or any other kind of data gathering and/or extraction tools is strictly prohibited.

16. Intellectual property and proprietary rights

    All intellectual property and other proprietary rights (i) in our Website and its content, and (ii) in any trademarks, trade names, domain names and product names used in our Website, are owned and expressly reserved by either Dufry, World Duty Free Group, its licensors or brand owners providing the Products. Any use of such rights without express prior written consent of the relevant brand owners is strictly prohibited.

18. How we may use your personal information

    Any personal information you supply to us when you use our Website will only be processed and used in accordance our Privacy Policy. By using our Website and/or using Reserve and Collect you consent to such processing and terms.

19. Feedback

    We welcome your comments and feedback regarding our Website, our services and as Product reviews. By submitting information in this way, you are hereby expressly granting us an irrevocable and unrestricted licence to use, modify, reproduce, display and distribute such information in any way and for any purpose whatsoever at our sole discretion. You also waive any and all moral rights in such information. Unless required by law, we will not obtain your prior written consent to attribute such information to you.

20. Other important terms

    1. We may at our sole discretion transfer our rights and obligations under these Terms to another organisation.

    2. Any contract concluded pursuant to these Terms is made between you and us. No other person shall have any rights to enforce any of its terms.

    3. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

    4. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

    5. The Terms, as amended from time to time, constitute the entire agreement between you and us regarding your rights and obligations in respect to your access to our Website and use of Reserve and Collect services we may provide you.

    6. These Terms are governed by the provisions of the law of the Republic of Serbia. You and we both agree to submit any disputes arising out of or in connection with this Terms to the exclusive jurisdiction of the courts of Serbia.

INTERNET PREZENTACIJA REZERVIŠI I POKUPI U SRBIJI

USLOVI

1. O ovim uslovima

   1. Ovu Internet prezentaciju i uslugu Rezerviši i Pokupi pruža Dufry d.o.o. Beograd (u daljem tekstu ,,mi/nas/nam/naš(e/i/a)’’). Mi smo društvo registrovano u Republici Srbiji, sa sedištem na adresi Aerodrom ,,Nikola Tesla’’, 11180 Beograd 59, Srbija. Svako upućivanje na ,,Vi/Vas/Vam’’ i ,,Vaš/-a/-e/-u/-em/-eg’’ podrazumeva korisnika naše Internet prezentacije i/ili usluge Rezerviši i Pokupi.

   2. Ovo su Uslovi koji se primenjuju na Vašu upotrebu naše Internet prezentacije i usluge Rezerviši i Pokupi, a korišćenjem naše Internet prezentacije i/ili usluge Rezerviši i Pokupi saglasni ste sa obavezom poštovanja istih. Ukoliko niste saglasni sa ovim Uslovima, ne smete koristiti našu Internet prezentaciju ili uslugu Rezerviši i Pokupi. Molimo pažljivo pročitajte ove Uslove i uverite se da ih razumete pre korišćenja predmetne Internet prezentacije ili usluge Rezerviši i Pokupi.

   3. Ovi Uslovi se primenjuju na svaki ugovor između nas, koji se može formirati prema uslovima koje dogovorimo pri Vašem pristupu našoj Internet prezentaciji i/ili pri upotrebi usluge Rezerviši i Pokupi.

   4. Ovi Uslovi odnose se samo na pregled i korišćenje ove Internet prezentacije i usluge Rezerviši i Pokupi od strane Vas. Ukoliko koristite jednu od veza (linkova) na ovoj Internet prezentaciji da biste posetili neku od internet prezentacija naših partnera, napominjemo da prilikom pregleda ovih internet prezentacija svaka kupovina koja se izvrši preko istih podleže posebnim uslovima.

   5. Reči u nastavku teksta imaju sledeća značenja kada se u ovim Uslovima javljaju napisane velikim slovima:

      ,,Proizvodi” proizvodi prikazani na našoj Internet prezentaciji ili obuhvaćeni rezervacijom;

      ,,Rezerviši i Pokupi” usluga rezervacije (koju nudimo preko naše Internet prezentacije i koja se reklamira u našoj prodavnici ili na drugim našim internet prezentacijima kao ,,Rezerviši i Pokupi’’) koja Vam omogućava da pre putovanja rezervišete Proizvode i preuzmete ih u našim bescarinskim prodavnicama na međunarodnom aerodromu Nikola Tesla (Beograd, Srbija) neposredno pre leta;

      ,,Uslovi”ovi uslovi i/ili ispravke i/ili izmene i dopune istih i ostala dokumenta navedene u istim, uključujući našu Politiku privatnosti; i

      ,,Internet prezentacija” naša internet prezentacija na shopdutyfree.com

   6. Ukoliko imate pitanja o ovim Uslovima ili biste želeli da razmotrite rezervaciju koju ste izvršili preko usluge Rezerviši i Pokupi, molimo obratite se našem timu za podršku potrošačima koristeći kontakt podatke navedene u članu 17 u daljem tekstu.

   7. Svaka upotreba reči ,,u pisanom obliku’’ ili ,,pismeno/-a/-e/-u’’, odnosi se na prepisku putem elektronske pošte osim ukoliko nije drugačije određeno.

2. Rezerviši i Pokupi

   1. Usluga Rezerviši i Pokupi dostupna je svim putnicima koji u skladu sa lokalnim zakonodavstvom imaju pravo da kupuju robu u bescarinskim prodavnicama. Podatke o našim prodavnicama i onima koje nude uslugu Rezerviši i Pokupi možete pronaći na Internet prezentaciji.

   2. Plaćanje Proizvoda rezervisanih putem usluge Rezerviši i Pokupi vrši se pri preuzimanju Proizvoda u našim prodavnicama. Niste u obavezi da izvršite plaćanje niti pružite informacije o plaćanju putem Internet prezentacije. Za više informacija o plaćanju molimo vidite član 11 u nastavku.

   3. Zahtevi za rezervaciju moraju se izvršiti najkasnije 24 sata pre polaska, a najranije mesec dana pre polaska. Zahtevi za rezervaciju koji se izvrše pre ili nakon navedenog vremena neće biti prihvaćeni. Napominjemo da se svi proizvodi koji se ne mogu rezervisati zbog navedenih vremenskih ograničenja mogu dodati u ,,listu želja’’ koja se čuva radi Vašeg budućeg pregleda.

   4. Nakon što izvršite zahtev za rezervaciju putem usluge Rezerviši i Pokupi, od nas ćete dobiti elektronsku poruku (u daljem tekstu: ,,Elektronska poruka o potvrdi prijema’’) kojom potvrđujemo prijem Vašeg zahteva, nakon čega Vam dodeljujemo broj zahteva za rezervaciju. Ovaj broj zahteva za rezervaciju se mora navoditi u svim naknadnim prepisima sa nama koji se odnose na Vaš zahtev. Napominjemo da je elektronska poruka o potvrdi samo potvrda prijema Vašeg zahteva i ne znači da je isti prihvaćen. Naše prihvatanje Vašeg zahteva kao stvarno potvrđene rezervacije vrši se kako je opisano u članu 2.6.

   5. U roku od sedam (7) dana od prijema naše elektronske poruke o potvrdi prijema trebalo bi da dobijete posebnu elektronsku poruku (u daljem tekstu: ,,Elektronska poruka o rezervaciji’’) kojom Vas obaveštavamo da li su Proizvodi koje želite dostupni i da li su rezervisani za Vas. Elektronska poruka o rezervaciji uključuje i datum na koji možete platiti i preuzeti Proizvode, kao i lokaciju na kojoj to možete učiniti.

   6. Pri korišćenju usluge Rezerviši i Pokupi, uverite se da su podaci potpuni i tačni pre podnošenja zahteva. Kao deo procesa rezervacije, od Vas se traži da navedete vreme, datum, aerodrom odlaska, odredište Vašeg leta i po potrebi broj leta. Posebnu pažnju posvetite tome da osigurate da su ove informacije tačne jer ćemo ih koristiti kako bismo utvrdili datum i vreme preuzimanja. Ukoliko, nakon podnošenja zahteva za rezervaciju, a pre prijema elektronske poruke o rezervaciji, shvatite da ste nam dostavili netačne informacije ili želite da izmenite rezervaciju, možete to učiniti putem Internet prezentacije prijavljivanjem na svoj nalog (ako je lozinka prethodno podešena prilikom poručivanja). Ukoliko shvatite da ste nam dostavili netačne informacije ili želite da promenite rezervaciju nakon prijema elektronske poruke o rezervaciji, trebalo bi da otkažete rezervaciju i izvršite novu. Ili se što pre obratite našem timu za podršku potrošačima koristeći kontakt podatke navedene u članu 17.

   7. Napominjemo da ni potvrda o prijemu niti elektronska poruka o rezervaciji ne predstavljaju obavezujuću ponudu niti ,,predugovor o kupoprodaji’’. Izvršenjem rezervacije rezervišete Proizvode koje ćete preuzeti i kupiti pri odlasku u skladu sa carinskim zahtevima i u prodavnici prema ovim Uslovima. Ispunjenje našeg međusobnog dogovora odvija se nakon plaćanja i preuzimanja Proizvoda u prodavnici. Vlasništvo nad Proizvodom koji rezervišete preko usluge Rezerviši i Pokupi prenosi se na Vas nakon preuzimanja i plaćanja istog u prodavnici u skladu sa uslovima prodaje.

   8. Rezervaciju možete otkazati u svakom trenutku, uključujući i nakon prijema elektronske poruke o rezervaciji. U slučaju da nam dostavite netačne ili nepotpune informacije tokom procesa rezervacije, kako se to zahteva shodno tački 2.6 ovih Uslova, kupovina Proizvoda Vam neće biti omogućena u prodavnici prema Vašoj rezervaciji (bez obzira na elektronsku poruku o rezervaciji).

   9. Zadržavamo pravo da u svakom trenutku otkažemo Vašu rezervaciju u celini ili delimično iz bilo kog razloga. U slučaju otkazivanja rezervacije, pokušaćemo da Vas obavestimo o tome pre Vašeg leta.

3. Proizvodi

   1. Slike proizvoda i ambalaže (ukoliko postoji) na našoj Internet prezentaciji navedene su samo u ilustrativne svrhe. Iako smo uložili najbolje napore u pogledu tačnog prikaza boja, ne možemo garantovati da prikaz boja na Vašem računaru tačno odražava boju proizvoda i/ili ambalaže. Proizvodi se mogu neznatno razlikovati od navedenih slika.

   2. Ambalaža proizvoda može se razlikovati od one prikazane na slikama na našoj prezentaciji.

   3. Svi Proizvodi prikazani na našoj Internet prezentaciji predmet su dostupnosti i bescarinskih ograničenja (videti član 7). Ovo će se najkasnije razmotriti sa Vama u vreme Vašeg leta, ali ćemo pokušati da Vas obavestimo putem elektronske poruke o rezervaciji ukoliko Proizvodi koje ste rezervisali nisu dostupni. Ovo prethodno elektronsko obaveštenje jednostavno ne može biti garantovano zbog vremena i administrativnih ograničenja.

   4. Asortiman Proizvoda koji se nude na našoj Internet prezentaciji i u našim prodavnicama (uključujući proizvode čija rezervacija Vam je potvrđena) podložan je promenama bez prethodnog obaveštenja i zadržavamo pravo da vršimo povremeno povlačenje ili prekid dostupnosti proizvoda sa naše Internet prezentacije.

4. Cena

   1. S dužnom pažnjom osiguravamo da cene Proizvoda budu tačne i ažurne. Međutim, ukoliko otkrijemo grešku u ceni Proizvoda koje ste rezervisali, za ono što se primenjuje u tom slučaju molimo pogledajte tačku 4.2. Cene Proizvoda mogu se povremeno menjati, ali se ove promene neće primenjivati na rezervaciju koju smo potvrdili u skladu sa tačkom 2.5.

   2. Naša prezentacija sadrži veliki broj Proizvoda. Uprkos našim razumnim naporima, postoji mogućnost da je cena nekih od Proizvoda na našoj prezentaciji pogrešna. Ukoliko otkrijemo grešku u ceni Proizvoda koje ste rezervisali, pokušaćemo da Vas obavestimo o ovoj grešci u pisanom obliku i pružićemo Vam mogućnost da nastavite sa rezervacijom Proizvoda po ispravnoj ceni ili da poništite svoju rezervaciju, jer ne želimo da Vam pružimo Proizvode po netačnoj ceni. Rezervaciju Proizvoda nećemo izvršiti dok ne dobijemo Vaša uputstva. Ukoliko nismo u mogućnosti da stupimo u kontakt sa Vama koristeći kontakt podatke koje ste naveli tokom procesa rezervacije, rezervaciju ćemo smatrati otkazanom.

   3. Zadržavamo pravo da vršimo povremene izmene cena Proizvoda, ali (osim u slučajevima kada su promene nastale zbog netačnih cena) te izmene neće se primenjivati na rezervacije koje su uspešno izvršene, što je potvrđeno elektronskom porukom o rezervaciji.

   4. Garancija najniže cene koju Vam nudi usluga Rezerviši i Pokupi predstavlja najbolju ponudu koja je dostupna u vreme kupovine. Ukoliko su, pri plaćanju i preuzimanju proizvoda, isti uključeni u promotivnu ponudu ili sniženi u prodavnici na dan preuzimanja, biće Vam naplaćena niža od sledeće dve navedene cene:

      1. Cena promotivne ponude ili popusta; ili

      2. Cena navedena u elektronskoj poruci o potvrdi prijema.

   5. Ovo se odnosi samo na broj Proizvoda koji su rezervisani i ne važi za proizvode koji su dodati u korpu u okviru prodavnice na aerodromu.

5. BEZBEDNOST

   Vi ste isključivo odgovorni u svakom pogledu za upotrebu i zaštitu poverljivosti korisničkog imena, potvrde elektronske pošte i lozinke, što Vam se dostavlja ili što odaberete za korišćenje na Internet prezentaciji. Deljenje ili prenos istih trećim licima nije dozvoljeno. Morate nas odmah obavestiti o svakoj neovlašćenoj upotrebi navedenog ili drugom vidu povrede bezbednosti u vezi sa Internet prezentacijom sa kojom ste upoznati.

6. Izmene ovih uslova

   1. Zadržavamo pravo na povremene izmene i/ili dopune ovih Uslova. Svaka takva promena stupa na snagu odmah po objavi na našoj Internet prezentaciji.

   2. Pri svakoj rezervaciji koju izvršite kod nas, na naš međusobni dogovor primenjuju se Uslovi koji važe u tom trenutku.

   3. Vaša dalja upotreba naše Internet prezentacije označava prihvatanje s Vaše strane obaveze poštovanja najnovijih Uslova.

7. Dostupnost proizvoda u trenutku preuzimanja

   1. Vaša rezervacija se automatski otkazuje, a Proizvodi se vraćaju u opštu prodavnicu ukoliko iz nekog razloga ne izvršite plaćanje i ne preuzmete Proizvode u roku od 24 sata od datuma preuzimanja i vremena navedenog u elektronskoj poruci o rezervaciji.

   2. Da bi se osigurala dostupnost Proizvoda u prodavnici koji su uključeni u promotivne ponude, mogu postojati ograničenja broja određenih promotivnih Proizvoda koje možete rezervisati. U slučaju da postoji takvo ograničenje, to se obično navodi na Internet prezentaciji i nećete moći rezervisati više od dozvoljenog broja Proizvoda.

   3. Dostupnost Proizvoda varira od prodavnice do prodavnice, a podaci o Proizvodima koji su dostupni za rezervaciju (gde usluga Rezerviši i Pokupi funkcioniše) prikazani su na Internet prezentaciji.

   4. Pri plaćanju i preuzimanju Proizvoda, zadržavamo pravo na ograničavanje broja određenog Proizvoda koji prodajemo ili otkazivanje Vaše rezervacije ukoliko Proizvodi nisu dostupni u trenutku preuzimanja.

   5. Ne snosimo odgovornost prema Vama ni na koji način u slučajevima kada se javljaju okolnosti pri kojima Proizvodi koje ste rezervisali nisu dostupni ili se ne mogu kupiti na dan Vašeg preuzimanja.

   6. Proizvodi su Vaša odgovornost nakon preuzimanja i prelaze u Vaš posed nakon izvršenja plaćanja u celosti.

8. Ograničenja

   1. Neki od naših Proizvoda podrazumevaju minimalne zahteve u pogledu starosnog doba (na primer, oni koji sadrže alkohol), a rezervisanjem ovih Proizvoda potvrđujete da ispunjavate ovaj zahtev. Zakon zabranjuje da vršimo snabdevanje ovih Proizvoda koji podležu ograničenjima ukoliko ne ispunjavate zahteve u pogledu starosnog doba. Ukoliko ste maloletni, molimo Vas da ne pokušavate da rezervišete ove Proizvode. Od Vas ili od lica koje imenujete može biti traženo da dostavi dokaz o starosnom dobu pri plaćanju i preuzimanju Proizvoda.

   2. Sve rezervacije podležu važećim carinskim propisima, ograničenjima količine ili težine koja propisuju aviokompanije i/ili bescarinskim propisima. Vaša je odgovornost da poštujete ove propise i ograničenja. Ako rezervišete Proizvode koji premašuju dozvoljene vrednosti prema odgovarajućim carinskim propisima, možete biti opomenuti (pri čemu mi nemamo obavezu da Vas opomenemo) da kupite samo broj Proizvoda u granicama utvrđenim važećim carinskim propisima. Ne snosimo obavezu ili odgovornost u slučaju da kupite više Proizvoda nego što to dozvoljavaju važeći propisi.

   3. Prilikom preuzimanja i plaćanja Proizvoda morate pokazati važeću kartu za ukrcavanje, u protivnom će Vaša rezervacija biti poništena i nećete moći da kupite Proizvode. Zadržavamo pravo da odbijemo kupovinu Proizvoda koji nisu dostupni za kupovinu za odredište navedeno na karti za ukrcavanje, ali nemamo nikakvu obavezu da to učinimo i ne snosimo obavezu ili odgovornost u slučaju da kupujete Proizvode koji nisu dostupni za odredište navedeno na Vašoj karti za ukrcavanje.

   4. Ako iz bilo kog razloga ne možete proći sigurnosnu proveru na aerodromu ka čekaonici za odlazak, nećemo biti u mogućnosti da ispunimo rezervaciju i Vaša rezervacija će biti poništena.

   5. Napominjemo da zbog carinskih propisa nismo u mogućnosti da dostavimo Proizvode koji nisu preuzeti na adresu izvan odgovarajuće aerodromske čekaonice za odlazak, a Proizvodi se mogu preuzeti samo sa određenog mesta preuzimanja na tom aerodromu.

9. Neispravni proizvodi

   Kao potrošač, imate zakonska prava koja se odnose na Proizvode koji su neispravni ili ne odgovaraju opisu. O Vašim zakonskim pravima možete se posavetovati sa lokalnim nadležnim organom za zaštitu potrošača. Ništa sadržano u ovim Uslovima ne utiče na ova zakonska prava.

10. Vraćanje

    Ukoliko niste zadovoljni Proizvodima iz bilo kog razloga, možete nam ih vratiti u skladu sa našom politikom vraćanja u roku od šezdeset (60) dana.

11. Plaćanje

    1. Niste obavezni da kupite Proizvode koje ste rezervisali koristeći uslugu Rezerviši i Pokupi. Ako se predomislite kada dođete da platite i preuzmete Proizvode, možete odabrati da zamenite Proizvode drugim artiklima koji su trenutno dostupni u prodavnici, pri čemu plaćate cenu prikazanu u prodavnici za ove artikle. U slučaju da više ne želite da kupite Proizvode, možete otkazati svoju porudžbinu preko Internet prezentacije pre odlaska ili obaveštavanjem člana osoblja u prodavnici.

    2. Prihvatamo plaćanje iznosa u raznim valutama u prodavnici. Ukoliko želite da platite u valuti koja nije srpski dinar (RSD), kurs za promenu u valutu kojom želite da platite utvrđuje se u skladu sa našim uslovima prodaje na dan stvarne kupovine.

12. Ograničenja garancije i odgovornosti

    1. U skladu sa tačkom 12.4, koristimo razumne napore pri potvrdi tačnosti svih informacija na Internet prezentaciji, pri čemu Vi prihvatate i slažete se da se Internet prezentacija i usluga Rezerviši i Pokupi pružaju ,,u viđenom stanju’’ i ,,shodno raspoloživosti’’, a mi ne pružamo izjave niti garancije bilo koje vrste, eksplicitne ili implicitne, zakonske ili druge u pogledu sadržaja ili dostupnosti Internet prezentacije ili da je blagovremena ili bez grešaka, da će se nedostaci otkloniti ili da Internet prezentacija ili server koji istu čini dostupnom ne sadrži viruse niti kvarove ili da predstavlja punu funkcionalnost, tačnost i pouzdanost Internet prezentacije. Ne snosimo obavezu niti odgovornost za gubitak sadržaja ili materijala učitanog ili prenetog putem Internet prezentacije i ne prihvatamo nikakvu odgovornost za gubitak ili štetu usled mera preduzetih oslanjanjem na materijal ili informacije koje Internet prezentacija sadrži.

    2. Prema odricanju od odgovornosti i ograničenju garancija ovde navedenih, u slučaju propusta sa naše strane da postupamo u skladu sa ovim Uslovima, odgovorni smo za svaki neposredan i stvarni gubitak ili štetu koju snosite, a što je predvidiv rezultat naše povrede ovih Uslova. Gubitak ili šteta su predvidivi ukoliko su očigledna posledica naše povrede ili ako su razmatrani od strane Vas i nas u trenutku sklapanja našeg međusobnog ugovora. U najvećoj meri dozvoljenoj važećim zakonom, mi nećemo biti odgovorni za drugu štetu bilo koje vrste, uključujući i posrednu, posebnu, posledičnu ili slučajnu ili drugu štetu koja nastane Vašom neposrednom ili posrednom upotrebom (ili usled Vaše nemogućnosti korišćenja) Internet prezentacije ili usluge Rezerviši i Pokupi.

    3. Vršimo snabdevanje samo Proizvoda za domaću i privatnu upotrebu. Slažete se da ne koristite proizvod za komercijalnu, poslovnu ili u svrhe preprodaje, a mi ne snosimo nikakvu odgovornost za gubitak profita, gubitak poslovanja, prekid poslovanja ili gubitak poslovne mogućnosti.

    4. Ni na koji način ne isključujemo niti ograničavamo našu odgovornost za:

       1. Smrt ili telesnu povredu čiji uzrok je naš nemar; i

       2. Prevaru i lažno prikazivanje.

    5. Saglasni ste da nas, naša povezana društva, direktore, službenike, zaposlene, zastupnika i davaoce licence obeštetite i oslobodite odgovornosti za sve obaveze, gubitke, štete, potraživanja i troškove, uključujući advokatske naknade, a u vezi sa (i) povredom ovih Uslova ili naših prava ili prava drugog lica ili subjekta ili važećeg zakona s Vaše strane, (ii) Vašom upotrebom ili zloupotrebom ili pristupom usluzi Rezerviši i Pokupi i/ili (iii) sadržajem koji postavljate putem Internet prezentacije. Radi izbegavanja nedoumica, ovaj član ostaje na snazi nakon prekida Vašeg naloga na Internet prezentaciji.

13. Korišćenje naše Internet prezentacije

    1. Vi ste isključivo odgovorni za sve aktivnosti dok koristite našu Internet prezentaciju i za sigurnost Vaših računarskih sistema. Vi preuzimate svu odgovornost za gubitke i štetu koju snosimo kao rezultat Vaše aktivnosti na našoj Internet prezentaciji, osim u slučaju da ti gubici nastaju zbog trećeg lica koje Vama nije poznato, a koje je namerno zloupotrebilo Vaše podatke za prijavu.

    2. Zadržavamo pravo na prekid Vašeg naloga na Internet prezentaciji ukoliko ne postupate u skladu sa ovim Uslovima ili važećim zakonima i propisima koji se odnose na korišćenje naše Internet prezentacije. Možete vršiti izmene ili otkazati registraciju naloga na Internet prezentaciji u svakom trenutku preko Internet prezentacije ili obraćanjem našem timu za podršku potrošačima koristeći kontakt podatke navedene u članu 17 u nastavku.

    3. Korišćenje Internet prezentacije u nezakonite ili prevarne svrhe je zabranjeno. Ne smete zloupotrebiti Internet prezentaciju uvođenjem virusa, trojanaca, crva, logičke bombe ili drugih zlonamernih ili tehnološki štetnih materijala. Naime, neovlašćen pristup, ometanje, oštećenje ili prekidanje Internet prezentacije ili dela iste; opreme ili mreže na kojoj se čuva Internet prezentacija; softvera koji se koristi za obezbeđivanje Internet prezentacije; ili opreme, softvera ili Internet prezentacije u vlasništvu ili koju koristi treće lice je zabranjeno. Ne smete vršiti napad Internet prezentacije putem napada odbijanja usluge.

    4. Bez obzira na naša druga prava ili pravne lekove dostupne prema zakonu, zadržavamo pravo na pokretanje pravnih postupaka protiv Vas za nadoknadu troškova ili gubitaka (na osnovu obeštećenja) koji proizilaze iz povrede tačke 13.3 s Vaše strane, i na otkrivanje informacija organima za sprovođenje zakona, kako smatramo neophodnim.

14. Događaji van naše kontrole

    1. Ne snosimo obavezu niti odgovornost za propust u ispunjavanju ili kašnjenje u ispunjavanju naših obaveza iz ovih Uslova usled događaja van naše kontrole.

    2. Događaj van naše kontrole u smislu ove tačke označava svaku radnju ili događaj izvan naše razumne kontrole, uključujući ali ne ograničavajući se na štrajkove, blokade ili druge industrijske radnje trećih lica, neispunjenje obaveza ili kašnjenje u ispunjenju obaveza od strane dobavljača, građanske nemire, pobunu, invaziju, terorističke napade ili pretnje terorističkog napada, rat (objavljen ili ne) ili pretnju ili pripremu za rat, požar, eksploziju, oluju, poplave, zemljotres, sleganje tla, epidemiju ili druge elementarne nepogode ili kvar javnih ili privatnih telekomunikacionih mreža.

    3. Ako se javi događaj van naše kontrole koji utiče na ispunjenje naših obaveza prema našem međusobnom sporazumu, obavestićemo Vas što je pre moguće.

15. Vaša ograničenja upotrebe naše Internet prezentacije

    Prema članu 16. u daljem tekstu, nije Vam dozvoljeno da preuzimate, kopirate, koristite, vršite, izrađujete izvedena dela ili koristite u komercijalne svrhe zaštićene ili druge informacije ili sadržaj na našoj Internet prezentaciji, uključujući, ali ne ograničavajući se na slike, cene ili opise proizvoda ili robne marke, zaštitne znakove, trgovačke nazive ili logotipe. Ovo uključuje sve kopije ili izvedena dela izrađena u korist trećih lica. Upotreba rudarenja podataka, robota ili druge vrste alata za prikupljanje i/ili izvođenje podataka strogo je zabranjena.

16. Intelektualna svojina i zaštićena intelektualna svojina

    Sva intelektualna svojina i druga zaštićena intelektualna svojina koja se odnosi na (i) našu Internet prezentaciju i sadržaj iste i (ii) zaštitne znakove, trgovačke nazive, nazive domena i proizvoda, koji se koriste na našoj Internet prezentaciji, u vlasništvu su Dufry, World Duty Free Grupe, davaoca licence istih ili vlasnika robnih marki koji pružaju Proizvode i isti zadržavaju izričita prava na navedeno. Svaka upotreba ovih prava bez izričite prethodne pismene saglasnosti vlasnika predmetnih robnih marki strogo je zabranjena.

    Ukoliko imate pitanja u vezi sa Vašom rezervacijom, možete pogledati svoj nalog ili podatke o porudžbini, stranice sa često postavljanim pitanjima ili u slučaju problema, molimo obratite se našem timu za podršku potrošačima. 18. Kako možemo koristiti Vaše podatke o ličnosti

    Podaci o ličnosti koje nam dostavljate pri korišćenju naše Internet prezentacije obrađuju se i koriste samo u skladu sa našom Politikom privatnosti. Korišćenjem naše Internet prezentacije i/ili usluge Rezerviši i Pokupi, pružate saglasnost na navedenu obradu i uslove.

19. Povratne informacije

    Rado primamo Vaše komentare i povratne informacije u vezi sa našom Internet prezentacijom, našim uslugama, kao i ocene Proizvoda. Podnošenjem informacija na ovaj način, izričito nam dajete neopozivu i neograničenu dozvolu za korišćenje, izmenu, umnožavanje, prikazivanje i distribuciju tih informacija na bilo koji način i za bilo koju svrhu po našem isključivom nahođenju. Takođe se odričete svih moralnih prava na te informacije. Osim ukoliko to nije predviđeno zakonom, nećemo pribaviti Vašu prethodnu pismenu saglasnost da Vam pripišemo te podatke.

20. Ostali uslovi od značaja

    1. Mi, po sopstvenom nahođenju, možemo preneti naša prava i obaveze prema ovim Uslovima drugoj organizaciji.

    2. Svaki ugovor zaključen u skladu sa ovim Uslovima zaključuje se između Vas i nas. Nijedno drugo lice neće imati nikakva prava na ostvarivanje ovih Uslova.

    3. Svaki stav ovih Uslova funkcioniše odvojeno. Ako sud ili nadležni organ odluči da je neki od stavova nezakonit, preostali stavovi ostaju na snazi i proizvode pravno dejstvo.

    4. U slučaju propusta sa naše strane da insistiraramo na ispunjenju Vaših obaveza prema ovim Uslovima ili ukoliko ne ostvarujemo svoja prava prema Vama, ili u slučaju kašnjenja u vršenju navedenog, to se neće smatrati odricanjem od naših prava prema Vama i neće značiti da ne morate da se pridržavate tih obaveza. U slučaju našeg odricanja od neispunjenja obaveza s Vaše strane, isto ćemo izvršiti isključivo u pisanom obliku, a to neće značiti da se automatski odričemo kasnijeg neispunjenja obaveza s Vaše strane.

    5. Ovi Uslovi, sa povremenim izmenama i dopunama, čine celokupni sporazum između Vas i nas u vezi sa Vašim pravima i obavezama u pogledu Vašeg pristupa našoj Internet prezentaciji i korišćenja usluge Rezerviši i Pokupi koje Vam pružamo.

    6. Ovi Uslovi regulisani su odredbama zakona Republike Srbije. Vi i mi se slažemo da svaki spor koji proističe iz ili u vezi sa ovim Uslovima podleže isključivoj nadležnosti sudova Srbije.
